Ukraine’s Government Initiates Review of Critical Enterprises for Employee Reservation

The Ukrainian government has launched a comprehensive review of businesses classified as critical, requiring them to meet updated criteria for employee reservation by July 1. This initiative aims to ensure that only companies genuinely contributing to defense, the economy, or public welfare retain their critical status.

According to a recent government decree, existing classifications of critical enterprises will remain valid only until their specified expiration date, but no longer than September 1, 2026. By June 10, central executive authorities and regional administrations are expected to reassess their criteria for determining which businesses qualify as critical.

Officials emphasized that the new criteria should apply exclusively to those companies that effectively support national defense and the essential needs of the population. Following this reassessment, a thorough examination of the current critical statuses will commence, with all relevant agencies required to evaluate compliance with the revised standards by July 1.

Potential Loss of Critical Status

One significant aspect of the new regulations is the possibility for businesses to lose their critical designation if the criteria under which they were initially classified are removed from the list. This change poses a risk of losing the right to reserve employees for companies that do not meet the updated requirements.

Timeline for Implementation

The government aims to complete the comprehensive review of critical enterprise classifications by September 1, 2026. Additionally, any new criteria established must be communicated to the Ministry of Digital Transformation within ten days of their approval.

Changes to Employee Reservation Rules

In late May, the government also revised the conditions for reserving military personnel. The salary threshold for reserving an employee will increase to three times the minimum wage, approximately 25,900 UAH, for most businesses.

The Ukrainian government is reviewing the status of critical enterprises, requiring compliance with new criteria for employee reservation by July 1. This initiative aims to ensure that only businesses genuinely supporting national interests retain their critical designation.
