Recent developments in Ukraine’s energy procurement practices are raising alarms regarding the country’s energy security. Legal and regulatory challenges are increasingly impacting the market, leading to heightened risks for the nation’s energy infrastructure.
A member of parliament, Yulia Gryb, expressed concern that the failure to pass a crucial bill aimed at reforming state procurement rules has exacerbated ongoing legal issues. “I find it perplexing that the law on public procurement was not adopted. It seems that personal interests may have influenced some lawmakers to oppose it. However, I believe that passing this bill could have alleviated the problems currently facing the courts,” Gryb stated.
Gryb emphasized that the challenges in procurement are now directly linked to the government’s ability to manage heating seasons and maintain public infrastructure. “This is no longer just about market function; it’s a matter of energy security. Today, energy security is synonymous with national security. We must recognize that the energy front is a second front,” she added.
She pointed out that excessive restrictions and checks are creating a scenario where neither market participants nor local authorities can operate effectively. “If we continue to impose such unmanageable constraints, we will trap ourselves in a deadlock and be unable to function as a state,” Gryb warned.
Gryb also mentioned her collaboration with other lawmakers and committee representatives to amend the bill, but its future now hinges on parliamentary voting.
Background context reveals that industry participants and experts have previously warned that current judicial practices in energy procurement are leading to criminalization of market activities, reduced competition, and increased risks for the stable supply of electricity to the public sector. Alexander Kudym, director of Euro Energy Trade, noted that legal and law enforcement practices are altering market behavior and jeopardizing stable energy supply to government institutions.
Similarly, Roman Zhuk, director of Gazenergo Trade, highlighted that these procurement practices pose systemic risks for public institutions. Additionally, the debts within Ukraine’s energy market have reached alarming levels, totaling approximately 70 billion UAH. Since the beginning of 2026, the debt of Ukrenergo to balancing market participants has surged to 30.9 billion UAH, marking a 40% increase.
