The Military Medical Commission (VLK) plays a crucial role in assessing the fitness of conscripted men for military service in Ukraine, particularly amid ongoing conflict. Legal expert Yulia Antoniuk has clarified the requirements surrounding the commission, including its validity period and the obligations of military personnel.
Under current legislation, men are required to undergo a VLK examination annually, provided they receive a summons. The obligation to attend the commission arises only when an official notice is delivered. Typically, this summons is issued during mobilization efforts or when an individual is seeking to enlist under a contract.
Annual VLK Requirements
According to Ministry of Defense Order No. 402, the VLK’s findings remain valid for a period of 12 months during wartime. However, if a man does not receive a summons and does not voluntarily attend, this does not constitute a violation of military registration rules. Conversely, if an individual neglects to receive or acknowledge the summons without valid reasons, this could be considered a breach.
Should the commission’s decision expire after 12 months, the individual is not required to report for another examination unless a new summons is issued or a follow-up date is specified in the previous decision. In cases where a person is classified as temporarily unfit, they are mandated to undergo re-examination after the initial 12-month period.
Exemptions from VLK Attendance
Individuals who possess a valid deferment or exemption from mobilization are generally not required to attend the VLK during the validity of such statuses. For instance, if a deferment is granted for three years, and the individual has not undergone a VLK during that time, this is not regarded as a violation of military regulations.
Additionally, individuals with disabilities, provided they have the appropriate documentation, are exempt from undergoing medical evaluations aimed at confirming their disability status. This exemption is in line with existing laws that protect the rights of disabled persons.
