The Ukrainian government has approved a new framework for defining the boundaries and usage regulations of cultural heritage protection zones. This initiative aims to streamline the establishment of protective zones around historical sites, cultural reserves, and conservation areas.
The Ministry of Culture announced that the updated regulations are designed to assist communities and municipalities in expediting the approval of necessary documentation, thereby integrating cultural heritage protection with urban development.
According to Deputy Prime Minister and Minister of Culture Tetyana Berezhna, the new framework establishes clear guidelines for heritage protection authorities, architects, communities, and businesses. She emphasized that the regulations aim to eliminate long-standing legal ambiguities that have hindered urban development while simultaneously enhancing the safeguarding of cultural monuments.
Previously, many regions faced significant delays in approving heritage protection documentation due to the lack of an established procedure. Consequently, a standard 100-meter protective zone was automatically enforced around monuments, which often obstructed renovations or new constructions even in cases where they posed no threat to cultural heritage. Moreover, these formal restrictions did not always guarantee adequate protection for the monuments themselves.
The new regulations allow for the establishment of tailored usage regimes for protection zones. This includes defining permissible building heights, dimensions, and conditions for new constructions adjacent to heritage sites. Developers are required to demonstrate that their proposed solutions will not adversely affect the monument or its historical context.
The Ministry of Culture also noted that the regulations were developed in collaboration with representatives from the professional community, civil society, and the business sector.
A separate resolution concerning qualification requirements for developers of scientific and project documentation is expected to be adopted in the near future.
