James Comey, the former director of the FBI, appeared in court in Virginia following allegations that he made a threat against President Donald Trump. The case centers on an Instagram post in which Comey arranged seashells to form the numbers “86 47,” which prosecutors claim could be interpreted as a serious threat.
Comey voluntarily surrendered to law enforcement and was presented before Judge William E. Fitzpatrick. The judge rejected the Justice Department’s request to impose conditions on Comey’s release, stating, “I do not believe any conditions of release are necessary in this case.”
He faces two charges: making a threat to take the life of or inflict bodily harm upon the president, and intentionally transmitting a communication containing a threat against the president. The charges stem from the aforementioned Instagram image, which prosecutors argue would be perceived by a reasonable observer as a serious intent to harm Trump.
The number “86” is often used in slang to signify getting rid of something, while Trump is recognized as the 47th president of the United States. Following the post, Comey faced backlash from Trump supporters, prompting him to delete the image. He later stated that he was unaware some individuals might connect the numbers to violence.
“It didn’t even occur to me, but I stand against any violence, which is why I deleted the post,” Comey remarked.
In a 2023 ruling, the U.S. Supreme Court established that for a statement to be classified as a “true threat,” the government must demonstrate that the speaker was aware of a significant risk that their words could cause harm to another individual.
