Ukraine’s Proposed Tax Legislation for Digital Platform Earnings Under Discussion

The Ukrainian Parliament is currently engaged in discussions regarding draft law No. 15111-d, which aims to regulate the taxation of income generated through digital platforms. This dialogue was highlighted during a roundtable organized by the American Chamber of Commerce in Ukraine, in collaboration with Diia.City United.

Natalia Mykolska, the Executive Director of Diia.City United, emphasized the significance of the proposed legislation for the advancement of Ukraine’s digital economy. She noted that the law requires clear explanations regarding its content and potential impact on businesses. The objective of the discussions is to establish a unified stance among stakeholders and to dispel misconceptions surrounding the draft law.

Mykolska pointed out that the business community is seeking a regulatory framework that is liberal, understandable, and transparent, which would foster the capitalization of Ukrainian tech companies and attract investments.

Conversely, Danilo Hetmantsev, the head of the parliamentary Committee on Finance, Taxation, and Customs Policy, stated that discussions on the draft law are nearing completion. He indicated that Parliament is awaiting a definitive position from the business sector regarding the law’s provisions. Hetmantsev asserted that the legislation aims to create clearer operational conditions for digital businesses and to remove them from the so-called ‘grey zone.’

He also criticized some public comments about the draft law, labeling them as distorted, and urged the business community to develop a consolidated position ahead of the second reading of the bill.

According to Hetmantsev, the draft law could be reviewed in its second reading as early as Tuesday.

Key Provisions of the Draft Law

If enacted, draft law No. 15111-d would require platform operators to identify users who earn income and report their earnings to the State Tax Service. This includes income from:

  • the sale of goods;
  • the provision of services;
  • real estate rentals;
  • vehicle rentals.

Reporting would occur annually through a specialized electronic service.

The Ukrainian Parliament is discussing draft law No. 15111-d, which seeks to regulate the taxation of income from digital platforms. Stakeholders are working to clarify the law's implications for businesses while aiming to establish a unified position ahead of its potential second reading.
