Ukraine’s Legislative Challenges: Nearly 300 Laws Needed for EU Compliance

Ukraine faces a significant legislative undertaking, requiring the passage of approximately 300 laws to meet the European Union’s criteria for membership. This information was shared by Deputy Prime Minister Taras Kachka, who emphasized the importance of consolidating these laws into larger packages rather than addressing them individually.

Kachka noted that the legislative efforts will encompass critical areas such as judicial reform, law enforcement, and updates to the Criminal Procedure Code. He indicated that this approach would streamline the process and enhance efficiency.

In addition to legislative reforms, some initiatives are being implemented at the Cabinet level. These include improvements in judicial expertise and the establishment of supervisory boards. Kachka highlighted the necessity for appointments within the Office of the Prosecutor General to be conducted through competitive processes, ensuring the institution’s independence.

“There must be not only a procedure but also an institution that will select candidates, and it must be trusted,” Kachka stated.

Looking ahead, Kachka mentioned a comprehensive update to Ukraine’s anti-corruption strategy, marking its second generation. This revised strategy will involve a thorough analysis of existing procedures and decisions within the government, identifying areas for improvement.

The Deputy Prime Minister acknowledged that while the first generation of the anti-corruption strategy had a high level of implementation, there remains room for enhancement. He emphasized that the updated strategy will also focus on the rule of law, aiming to rectify any shortcomings.

Financial oversight and auditing will be integral components of this strategy. Kachka referenced a report prepared by Marek Belka, head of the auditing committee under the Ukraine Facility, which outlines steps for internal auditing that align with EU standards.

Moreover, Kachka stressed the importance of involving international experts in the development of institutions and the execution of competitive processes. He noted that these experts are already engaged in various sectors, although their integration into Ukrainian systems can be challenging.

“This experience is painful for everyone, as it requires understanding Ukrainian culture and the new elements introduced by international professionals,” he explained.

He also pointed out that the involvement of international experts is crucial for building trust within the EU, which is essential for Ukraine’s accession to the bloc. Kachka elaborated on the need for this trust, stating that EU operations rely on the consistency and reliability of documentation issued by local authorities, which must be recognized across member states.

Ukraine is set to enact around 300 laws to comply with EU membership requirements, focusing on judicial reforms and anti-corruption strategies. The involvement of international experts is deemed essential for building trust and ensuring effective implementation.
