According to the court ruling, the phrase is now a political slogan, becoming “a symbol of Ukraine’s struggle against Russian aggression” shortly after it was first uttered. “So it will not be perceived by the relevant public as an indication of the commercial origin of the goods and services it denotes,” the court ruled.

As early as 2022, the State Security Service tried to register a trademark of this expression in the European Union for a wide list of goods, in particular, clothing, printed products, various accessories, etc. However, in December 2023, the European Intellectual Property Agency (EUIPO) refused registration due to a number of reasons, including the moral side of the issue.
DPSU did not agree with the decision of the European regulator and challenged this decision in the EU court. Today’s verdict can also be challenged in a higher court.
