Detention for violation of mobilization rules can last up to three hours – deputy head of RTCC

In case of disobedience to police or TCC officers, citizens may be detained for up to three hours. In case of physical impact, this term can be extended up to three days.

Despite the assurances of the Ombudsman of Ukraine about the decrease in the number of so-called busification, videos of cases where men are forcibly detained by TCC employees still appear on the Internet.

The term busification is spreading in civil society, but what does it come from? At the legislative level, according to the Cabinet of Ministers of Ukraine, police officers in alert groups and military personnel of territorial recruiting and social support centers are allowed to search for citizens who in some way evade the established rules of military registration, duty. In my practice, what happens is that citizens who are wanted and there is a real established fact of the transmission of a message to the competent authorities of the National Police, they are offered to voluntarily proceed to the district territorial center of recruitment and social support to update their data or eliminate those obstacles that contributed to them wanted transfer. In the event that a citizen commits malicious disobedience, I repeat, either to police officers or TCC employees, there is also a corresponding provision in the Code of Ukraine on Administrative Offenses, which allows police officers to carry out administrative detention of such a citizen under the protocol, which has a certain term – up to three hours

She explained that if a citizen disobeys by using physical influence on military personnel, the term of detention can last even three days.

As for the videos in which people, according to the public, are forcibly placed in vehicles, analyzing their full picture, it can be concluded that it was insubordination, which was confirmed by the administrative record of detention. After being delivered by the National Police or the TCC, the person is subject to an appropriate administrative penalty in the form of a fine or a sanction provided for by the Code of Ukraine on Administrative Detention. This is part of practice and one of the mechanisms of legislative regulation.

But, again, this is not so much mobilization as the elimination of violations by citizens who, in one way or another, ignore the rules established by military registration and staying on the register
