President Volodymyr Zelenskyi signed draft law No. 10319 on amendments to the Tax Code regarding the fight against bribery of foreign officials in international business transactions. This was announced by the first deputy head of the Verkhovna Rada Committee on Tax and Customs Policy, People’s Deputy from the “Voice” faction Yaroslav Zheleznyak. According to him, signing the document was Ukraine’s commitment to the Organization for Economic Cooperation and Development. Previously, the Ministry of Finance explained that the law will contribute to the introduction of international tax standards in the field of combating bribery of foreign officials and will contribute to Ukraine’s approach to membership in the OECD. Advertisement: The main provisions of the draft law are: the introduction of a ban on deducting expenses for taxation purposes in transactions related to with providing undue benefits to officials; supplementing the functions of the supervisory body in providing NABU and the taxpayer with notices about the circumstances discovered during the inspection, which may indicate the granting of an illegal benefit. At the same time, both the DPS and the taxpayer will be guided by the list of such circumstances, which will be formed and approved by NABU in agreement with the Ministry of Finance; giving the taxpayer the opportunity to independently adjust his tax obligations, if the facts of the granting of an unlawful benefit really occurred; carrying out an unscheduled documentary inspection of a taxpayer in respect of whom a court verdict has been issued on providing an illegal benefit to an official; an increase in the taxpayer’s financial result by the amount of expenses for which, in accordance with the legislation, it is established that they were made with the purpose of providing him with an unlawful benefit.
