Zelensky brought to the Council a bill with the norms on independence of NABU and SAP

The Bill of President of Ukraine Volodymyr Zelensky on the powers of the anti -corruption bodies of NABU and SAP appeared on the website of the Verkhovna Rada.

Details: Earlier, Zelensky reported that he had already agreed on the text of a new bill, which should “strengthen” the independence of anti -corruption bodies and that it would bring it to the BP on Thursday.

It states that the bill aims to “guarantee the strengthening of NABU and SAP’s institutional independence.” The presidential initiative also contains:

• The Prosecutor General and his deputies have no right to give instructions to the SAP prosecutors and to take other actions that are directly related to the SAP prosecutors. Written orders of an administrative nature regarding the activities of the SAP are issued by the obligatory agreement of the Deputy Prosecutor General – Head of the SAP;
• NABU employees who have access to the State Security SBU
• NABU can be obtained by other bodies if their jurisdiction is found there. This requires the decision of NABU and approval with the SAP prosecutor;
• The SAP head may transfer NABU cases to other bodies in cases where NABU cannot carry out pre -trial investigation for objective reasons;
• SAP prosecutors have the opportunity for written instructions to NABU detectives, if the detective refuses – it is responsible for it;
• NABU staff will be prohibited from traveling abroad at the time of martial law except for office trips;
• The Prosecutor General may transfer Bab’s cases to other bodies.

Prehistory:

• The SBU and OGP staff conducted at least 70 searches in 15 employees of the National Bureau of Investigation in different regions of Ukraine on July 21. NABU reported that the security forces did not have court rulings to conduct searches.
• NABU detectives are charged with treason, illegal trade with Russia, corruption in the interests of the oligarchs. At the same time, the State Bureau of Investigation was intensified with the materials of road accidents several years ago with the participation of NABU staff.
• On July 22, the Verkhovna Rada approved Law No. 12414 as amended to the Criminal Procedure Code, according to which NABU and SAPs become dependent on the decisions of the Prosecutor General. On the evening of July 22, the President signed the document.
• In many cities of Ukraine, protests have taken place after this legislative initiative was adopted.
• Subsequently, Zelensky promised to submit to the Verkhovna Rada a bill, which will provide “force of the system of law enforcement” and preserve “all rules for the independence of anti -corruption institutions”.
