Details: In its appeal to the Supreme Court, the administration states that the current practice of granting citizenship under birth undermines the security of the US borders.

He stressed that the courts “without legitimate grounds give the privilege of American citizenship hundreds of thousands of people who do not have the right to do so.”
The administration insists that the historic decision of the Supreme Court in the case of “USA v. Vong Kim Ark” in 1898, which enshrined the right to citizenship for born in the United States, was incorrectly interpreted. In their view, this decision concerned only the children of immigrants who had a “permanent residence” in the country.
Presidential Trump’s decree entitled “Protecting the Value and Value of American Citizenship”, signed on January 20, prohibits citizenship for children whose parents were in the country illegally or on the basis of temporary visas.
This policy was immediately appealed in the courts. In July, the Federal Court of Appeal in San Francisco supported the nationwide blocking of the decree. Separately, a judge in New Gampshire made a similar decision in a collective lawsuit filed by the American Union of Civil Liberties (ACLU).
“This decree is illegal, the point, and no administration maneuvers will change it,” ACLU’s lawyer Kody Wavesi said.
He stressed that the organization would continue to fight so that “no child is denied citizenship because of this cruel and senseless decree.”
Earlier, the 9th District Court of Appeal in its decision ruled that Trump’s decree contains directly contrary to the provision of the Constitution on citizenship, the precedent in the case of Wong Kim Ark and the decades of established executive practice.
“The interpretation proposed in the decree … is unconstitutional. We fully agree with that,” – wrote Judge Ronald Guld on behalf of the majority.
It is unknown whether at least four of the nine judges of the Supreme Court will agree to consider the case as required by the procedure.
