The Appellate Chamber of the High Anti-Corruption Court overturned the arrest in absentia of former People’s Deputy Yury Ivanyushchenko. The court came to the conclusion that the former deputy was not properly informed about the meeting at which the preventive measure was chosen. About this informs Anti-corruption Center (CPC).
The decision was made by a panel of judges consisting of Mykola Glotov, Oleg Pavlyshyn and Andrii Nikiforov. According to the Central Committee of the Central Committee of Ukraine, the key reason was that Ivanyushchenko, according to the court, “was not properly informed” about the meeting during which a preventive measure was chosen for him.
The Anti-Corruption Center explained the consequences of this decision. “Now the request for detention will be considered again in the first instance. And this means that there will be no talk of the extradition process yet,” the organization noted.
According to the mass media, Yuriy Ivanyushchenko currently lives in Monaco and will continue to stay there after the decision of the appeals chamber. “We are waiting for a new hearing in the court of first instance,” the Central Committee added.
Ivanyushchenko, also known as Yura Yenakievskyi, appears in a number of criminal proceedings. In particular, he was a partner of the capital developer Vlada Molchanova in the case concerning the “Stolichny” market. According to the investigation, a corporate conflict arose between the partners over control of the market, which, according to the law enforcement officers, they tried to solve by circumventing the law.
Currently, the case regarding the preventive measure for the former deputy of the People’s Republic of Ukraine actually returns to the starting position — the decision must be made again by the court of first instance.
