The Appellate Chamber of the Higher Anti-Corruption Court confirmed the punishment imposed on the former head of the Druzhkiv city court of the Donetsk region and the ex-prosecutor of the local prosecutor’s office.
As reported in the Specialized Anti-Corruption Prosecutor’s Office, on February 10, the panel of judges supported the position of the prosecution and did not make any changes to the VAX verdict, adopted on December 16, 2024, in terms of punishment.
We are talking about the former head of the Druzhkiv City Court H. Moliboga and the ex-prosecutor of the Druzhkivsk Department of the Kramatorsk Local Prosecutor’s Office of the Donetsk Oblast V. Yagupets.
The court found the retired judge guilty under Part 3 of Art. 368 of the Criminal Code of Ukraine and sentenced him to 7 years and 6 months of imprisonment. He was also deprived of the right to hold positions in local authorities and local self-government bodies for a period of two years, and confiscation of half of the property was applied.
The former prosecutor was convicted under Part 3 of Art. 369 of the Criminal Code of Ukraine up to 4 years and 6 months of imprisonment.
SAP noted that the case concerns the events of December 2017. Then the prosecutor, using official connections, offered and gave an illegal benefit to the head of the court for making a decision not to bring two people to administrative responsibility for driving a vehicle while intoxicated.
In 2018, the Prosecutors’ Qualification and Disciplinary Commission dismissed the person involved in the case from the prosecutor’s office.
The decision of the Appeals Chamber of the VAKS entered into force from the moment of its announcement and can be appealed to the Supreme Court in the cassation procedure within three months.
