The Tax Committee of the Council supported the liquidation of KRAIL and new restrictions on the gambling business

Today, November 27, the Verkhovna Rada Committee on Finance, Tax and Customs Policy at a meeting supported draft law No. 9256-d on the liquidation of the Commission for the Regulation of Gambling and Lotteries (KRAIL) and restrictions on gambling advertising. Today, November 27, the Verkhovna Rada Committee on Finance, Tax and Customs Policy at a meeting supported draft law No. 9256-d on the liquidation of the Commission for the Regulation of Gambling and Lotteries (KRAIL) and restrictions on gambling advertising.

People’s deputy Yaroslav Zheleznyak reported this Telegram.

“The committee finally considered the draft law #9256d on strengthening control over the gambling market as a whole. ZA – 23. UTR – 1”, – wrote Zheleznyak.

The document includes several new rules:

1. KRAIL is liquidated. Instead, by April 1, 2025, a new authorized body will be formed and the Ministry will be determined, which will shape the policy in the field of gambling business and lotteries.

2. It is planned to introduce a mechanism for restricting access to illegal gambling websites/mobile applications.

3. Gambling advertising is prohibited, except for exceptions: on TV and radio at night, in the media – for people over 21 years old, on platforms and search engines – with a target audience over 21 years old.

4. Prohibition on:

  • offering or providing reimbursement for gambling expenses;

  • making phone calls, sending messages to an unspecified circle of people;

  • offering free bonuses instead of placing a bet.

5. The participation of military personnel, volunteers, popular persons, as well as the use of topics related to war are prohibited in advertising.

6. Prohibition on obtaining a license by persons who were owners or officials of gambling companies that have a tax debt or a debt for the payment of licenses.

7. Settlements for gambling must be made exclusively in cash through current bank accounts. The use of other payment services is prohibited.

8. Sponsorship, except for sports, is prohibited.

9. Lotteries are subject to most gambling business restrictions: requirements for the reputation of officials, tax debt, relations with the aggressor country, exclusively bank settlements.

10. It is allowed to obtain a license for conducting state lotteries to foreign entities with relevant experience.

11. The rules regarding the mandatory use of PRO by the gambling business are clarified.

12. The rules regarding the impossibility of obtaining a license by persons connected with the aggressor country are clarified. The use of their brands is prohibited.

13. New limits on spending and playing time, as well as mandatory breaks.

14. “Control purchases” during inspections with video recording.

15. Prohibition on accepting bets on credit or with subsequent payment.

In April 2024, the Verkhovna Rada approved draft law No. 9256-d on the liquidation of KRAIL and strengthening control over the gambling business in the first reading.

In response, the head of the Commission for the Regulation of Gambling and Lotteries, Ivan Rudy, said that the service continues to work, making decisions in favor of the state.
