The Supreme Court took a step to reduce the fine for not clarifying data in the TCC

The Verkhovna Rada has taken a step towards reducing the fine for not clarifying data in the Central Committee of the Russian Federation. More than 6 million conscripts did not update their data in 2024.”, — write on: unn.ua

The Verkhovna Rada adopted as a basis in the first reading draft law No. 12093, which proposes to provide citizens with a 50% discount when paying a fine for untimely clarification of military registration data, reports UNN.

Yes, 231 people’s deputies voted “for” in the first reading. The draft law proposes amendments to the Code of Ukraine on Administrative Offenses (hereinafter referred to as the Code of Administrative Offenses), in particular:

⦁ to add a new article 2799, which will allow a person who is brought to administrative responsibility under articles 210, 2101 of the Code of Administrative Offenses to submit an application to the TCC and SP, in which to independently report the fact of committing the specified offense and to give consent to consider the case in his absence;

⦁ to add a new Article 3003, which allows a person who is brought to administrative responsibility, in accordance with Article 2799 of the Code of Criminal Procedure, to voluntarily pay 50% of the imposed fine within 10 calendar days from the date of entry into force of the resolution.

In addition, it is proposed to make changes to a number of other articles of the Code of Administrative Offenses in order to bring them into line with the provisions proposed by the draft law. It is expected that the adoption of these changes will have a positive effect on:

⦁ encouraging conscripts to update their data in accordance with the Rules for military registration of conscripts, conscripts and reservists approved by the Resolution of the CMU dated December 30, 2022. No. 1487, through the Electronic office of a conscript, conscript, reservist;

⦁ ensuring that the Unified State Register of conscripts, conscripts and reservists is filled with information on the personal data of a large number of citizens conscripted;

It is also envisaged to improve the review procedure in the special period of administrative offenses provided for in articles 210, 2101 of the Code of Administrative Offenses, and to provide an opportunity for citizens who have not specified the data without valid reasons to voluntarily pay 50% of the minimum sanction of the article by independently applying to the TCC and SP through the Electronic Office of military service conscript, conscript, reservist.

We would like to add that failure to clarify personal data within 60 days without valid reasons is an administrative offense punishable by a fine from UAH 17,000 to UAH 25,500.

The explanatory note to the draft law indicates that during 2024, more than 6,000,000 conscripted citizens did not specify their personal data through the center for the provision of administrative services or through the electronic office of the conscript, conscript, reservist, or in the district (city) territorial center staffing and social support within 60 days from the date of entry into force of the decree of the President of Ukraine announcing mobilization.
