Details: According to the court’s explanation, the Verkhovna Rada of Ukraine adopted another law, which established a direct ban on changing the purpose of nature conservation fund lands for such needs.
The law states that it is not allowed to change the purpose of land plots on the lands of the nature reserve fund for the purpose of placing a cemetery.
However, according to the court, despite the legal ban, the Kyiv OVA decided to change the purpose of the plot belonging to nature conservation lands and used it to create a memorial.
Literally: “The inconsistency of these actions with the law and the illegality of the adopted administrative decisions were confirmed in this case by the courts, in particular the Supreme Court.”
