The Russian government has approved amendments that propose to prohibit extradition to other countries for criminal prosecution and execution of foreigners who have signed a contract with the Russian Ministry of Defense to participate in hostilities against Ukraine.

The relevant amendments were approved by the government commission on legislative activities. Three bills concerning foreigners and stateless persons who have signed contracts with the Russian Ministry of Defense are proposed to the Russian State Duma.

  • Ban on removal and deportation: According to the amendments, such persons cannot be subject to administrative removal. Instead, they are offered to impose a fine from 1,000 to 50,000 rubles or compulsory work.
  • Annulment of Decisions: An amendment is made to the Law on the Legal Status of Foreigners, according to which decisions on deportation, readmission, closure of entry, undesirability of residence, and cancellation of residence permits made “after February 24, 2022” “shall cease to be effective and shall not be enforced.” This also applies to refusals to issue or cancellation of patents and work permits.

Deputy of the Russian State Duma Oleksiy Kurinny noted that in the CIS countries (Tajikistan, Kyrgyzstan and Kazakhstan) local courts sentenced their compatriots who fought against Ukraine under the article on mercenaries. He believes that the new legislative changes will be “an additional incentive for foreigners who fight against Ukraine.”

It will be recalled that in July of this year, Vladimir Putin signed a law that allows stateless persons to serve under a contract in the Russian army.

The Supreme Court of Appeal in Prague confirmed the sentence of 21 years in prison to former soldier Martin Sukup for his active participation in hostilities in Ukraine on the side of the Russians between 2014 and 2018.

Earlier, the court of the Tashkent region of Uzbekistan sentenced a 38-year-old citizen of Uzbekistan who fought in the so-called “army of the DNR” to five years in prison.

In Serbia, the court found 31-year-old Vlado Stanich guilty of mercenary. He participated in the war in Ukraine on the side of the Russian Federation. The court sentenced Stanich to one year in prison.
