The commercial court of the city of Kyiv refused to satisfy the lawsuit of the prosecutor’s office, which wanted to condemn LLC “Pokermatch.YUA” for 6 million UAH for non-payment of the license. This is evidenced by the court decision of December 4. In 2021, the Gambling and Lottery Regulatory Commission (KRAIL) issued “Pokermatch.YA” LLC a license to organize and conduct online poker gambling for a period of 5 years. In 2023, the National Security and Defense Council of Ukraine (NSDC) imposed sanctions on the company. Advertisement: The Prosecutor’s Office appealed to the court to recover from “Pokermatch.UA” 6 million UAH, as well as 162.5 thousand UAH 3% annual and 150 thousand UAH inflationary losses, since the company, contrary to the requirements of the law “On State Regulation of Activities Regarding the Organization and Conduct of Gambling Games”, did not pay for the third year of validity of the issued her license. At the same time, the court noted that on June 4, 2023, the NSDC imposed sanctions on “Pokermatch.YUA”, as a result of which its economic activity was suspended. And in addition to the application of sanctions regarding the cancellation or suspension of the license, sanctions were applied to it in the form of blocking assets, limiting trade operations; suspension of economic and financial obligations; prohibition to dispose of intangible assets, in particular rights to trademarks, domain names, etc.; blocking by Internet providers of access to web resources/services located on domains and subdomains https://pokermatch.ua, etc. Advertising: Therefore, the court concluded that “Pokermatch.UA” has no obligation to pay for the third year of license validity, since it was not extended for 2023-2024, and sanctions in the form of cancellation of company licenses were put into effect by the decree of the President of Ukraine from 10.03.2023. In addition, “Pokermatch.YUA” has no arrears for the payment of the license for the first and second year. LLC “Pokermatch.UA” is registered under the Cypriot company “VIPLAY MEDIA HOLDING LIMITED”, the beneficiary is Kateryna Beloruska (Cyprus). We will remind: the Commercial Court of the city of Kyiv collected UAH 17 million from Fan Game LLC (co-owned by the head of the Ukrainian Association of Gambling Businesses Tamara Golubchyk) for the benefit of the budget, which did not pay for the gambling license.
