Waves of those accused of rioting at the US Capitol are citing the election of Donald Trump as justification for their requests to delay their criminal prosecutions. They recall his public promise to pardon some people convicted of crimes on January 6, 2021.
CBS News has seen court documents in which defense attorneys are asking federal judges to delay some of the Capitol storming cases until after Trump takes office.
A lawyer for one of the defendants noted that during Trump’s first term as president, Trump pardoned, commuted or canceled the sentences of 237 people, although many of them were controversial. Some of the defendants are citing Trump’s campaign statements in their new court filings.
The number of requests for adjournment is expected to increase significantly. Attorney Joseph McBride, who represented several of the criminal defendants on Jan. 6, told CBS News that requests to delay the cases before Trump takes office will be made by all of the defendants.
