The Ivano-Frankivsk city court allowed a serviceman who voluntarily left the military unit to return to the front without punishment. He faced 5 to 10 years in prison. The military man was indicted under Part 5 of Art. 407 of the Criminal Code of Ukraine (Unwillingly leaving a military unit or place of service by a serviceman, as well as his failure to report for duty on time without valid reasons, committed in a combat environment, as well as the same actions lasting more than three days, committed in martial law conditions, are punishable imprisonment for a term of five to ten years.

On October 21, the suspect in the SZC appealed to the prosecutor with a request to release him from criminal responsibility. The man also expressed his intention to return to the service.

“The prosecutor supported the submitted petition, as the soldier committed a criminal offense for the first time. There is also a written consent of the commander of the military unit to continue the service,” the decision said.

Thus, the court closed the criminal proceedings and released the soldier from serving his sentence. After the decision enters into force, he must return to the military unit no later than 72 hours later.

In August 2024, the Verkhovna Rada of Ukraine allowed servicemen who voluntarily left their unit or deserted for the first time to petition for return to service. It will be possible to extend it both in the part (with the consent of the command) from which the soldier fled, and in any other that agrees to accept him. Then the criminal proceedings can be closed.

After the adoption of these changes, the number of appeals from servicemen who went to the SZCH and want to return to service increased, the Military Law and Order Service told “Suspilny”. However, so far the mechanism for returning to service after the first case of SZH has not worked for servicemen already in custody.

Earlier, the Security Service detained a deserter who was correcting Russian airstrikes in the Vinnytsia and Sumy regions.
