The Commercial Court of the city of Kyiv obliged PJSC “Zaporizhjiaoblenergo” to return to the State Property Fund the monument of architecture and urban planning, history of local importance The building of the first thermal power station, which is located in Zaporizhzhia on the street Poshtova (formerly Gorky).
About this testifies court decision from November 12.
The court established that the building of the first thermal power plant was transferred to the statutory fund of PJSC “Zaporizhjiaoblenergo”, but is actually in state ownership, despite the registration of private property rights for “Zaporizhjiaoblenergo” in 2020.
That is, according to the court, the historical monument never fell from the ownership of the state, but was transferred only under the right of economic dedication to PJSC “Zaporizhjiaoblenergo”.
And the state status of the Building of the first thermal power plant was preserved and is preserved, despite the fact that it was not previously included in the list of objects that are not subject to privatization.
Previously, this case was repeatedly considered in courts.
The building of the first thermal power plant is located on an area of 1151.8 square meters and is a unique example of the synthesis of various elements of architecture. It was built in 1910 for the purpose of organizing electric lighting in the city of Oleksandrivska (now Zaporizhzhia). The power station began operation at the beginning of 1911.
“Zaporizhiaoblenergom” owns state. In accordance with data youcontrol, a minority share of state-owned enterprises belongs to Cypriot companies BIKONTIA ENTEPRISES, KERELIO COMMERCIAL and LEX PERFECTA. In accordance with investigation “Radio Liberty”, they belonged to the Surkis brothers, “Privat” of Igor Kolomoiskyi and Viktor Medvedchuk. The Surkises had actual control over the company through the “Energomerezh” company. NABU detectives suspected that this company had withdrawn UAH 346 million from Oblenergo.
