The German court did not recognize the detonation of “Nord Stream” as an act of self-defense of Ukraine

The Federal Court of Germany recognized the undermining of the Nord Stream gas pipelines as an act of unconstitutional sabotage and denied immunity to the Ukrainian suspect. The Federal Court of Germany recognized the undermining of the Nord Stream gas pipelines as an act of unconstitutional sabotage and denied immunity to the Ukrainian suspect.

This is stated in the press release of the court.

The German Themis rejected the appeal of Serhiy K., a citizen of Ukraine, whom the prosecutor’s office considers the key coordinator of a group of saboteurs who operated from aboard a sailing yacht. The judge officially refused to recognize the destruction of the pipelines as part of the legitimate defensive actions of the Defense Forces of Ukraine, emphasizing the civilian status of the objects. Thus, the suspect continues to be charged with anti-constitutional sabotage combined with causing an explosion, which makes it impossible to release the defendant from responsibility due to the status of a combatant.

The legal position of the German court is based on the belief that the immunity of a public official or military does not extend to covert violent operations controlled by special services outside the open battlefield. The lawyers tried to prove that the Ukrainian’s actions were dictated by the state of war, in which Russia is the aggressor, but the court noted that international law does not protect against prosecution for the destruction of civilian infrastructure in this way. The decision sets a precedent whereby involvement in the operation is seen as a criminal offense against German security rather than a legitimate military action.

Despite the fact that Russia has used energy resources as a tool for political pressure and war financing for years, German justice separates the issue of geopolitics from the criminal code. While Russia is trying to use international platforms to accuse Western countries of undermining, the investigation in Germany continues to focus on the Ukrainian trail. This court decision actually confirms Berlin’s intention to bring the case to a verdict, ignoring the arguments about the strategic necessity of liquidating the pipelines through which Russia supplied gas to Europe.

The Supreme Court of Italy has decided to extradite 49-year-old Ukrainian Serhiy Kuznetsov to Germany, where he is suspected of involvement in blowing up the Nord Stream gas pipelines.

Ukraine will continue to provide comprehensive assistance to Ukrainian citizen and military serviceman Serhiy Kuznetsov, who is connected with the case of undermining the Nord Stream and Nord Stream 2 gas pipelines.
