Details: Maybozhenko was found guilty of an accident in a state of intoxication. The court imposed a penalty of 34 thousand hryvnias and deprivation of the right to drive vehicles for three years.
He is also obliged to pay 31 432 hryvnias for judicial examinations and other court costs.
The Volvo car, which the accused managed at the time of the accident, will be returned because it was stored on the penalty area during the case.
Subsequently, the Kyiv Regional Prosecutor’s Office was informed that they would challenge the sentence in the Court of Appeal.
The prosecutor’s office is literally: “The Kyiv Regional Prosecutor’s Office disagrees with the decision of the Brovarsky City Court and will insist on the cancellation of a sentence in the case of ex-head of the Brovar Regional State Administration, which in April 2024 was in a state of alcohol intoxication on four pedestrians, including a minor child Brovary, Kyiv region. ”
Details: The prosecutor filed a written objection, stating the impossibility of concluding such an agreement in such proceedings. According to him, its conditions are contrary to the public interests and the requirements of the Criminal Code, since the penalty provided for the penalty agreement does not meet the sanctions of the article. The prosecutor also emphasized the absence of grounds for mitigation under Part 1 of Art. 69 of the Criminal Code of Ukraine.
In addition, the court denied the prosecutor in the study of case files that indicate the lack of mitigating circumstances, including the active assistance of the accused in the detection of a crime.
