The court punished the company of Zlochevsky’s son-in-law for receiving excess funds from part of the Ministry of Defense

The Commercial Court of the city of Kyiv recovered almost UAH 700,000 of unjustified funds from the Ukr Gas Resurs LLC in favor of the Zvyagel Apartment and Operating Unit (KECH) of the Ministry of Defense (Zhytomyr Region), declaring invalid a number of additional agreements to the electricity supply contract. This is evidenced by the court decision of January 15. On February 15, 2021, Zvyagelsk KEC (district) of Zhytomyr region, as the legal successor of Novograd-Volynsk KEC district, ordered “Ukr Gas Resources” 6.5 million kWh of electricity for 12.5 million UAH. The price of electricity was UAH 1.92 per 1 kW/h. Later, the parties concluded a number of additional agreements, according to which the tariff for 1 kW/h increased to UAH 2.75. Advertisement: The court found that according to four additional agreements, Zvyagelska KEC and “Ukr Gas Resurs” increased the price of electricity by more than 10% (one of the additional agreements increased the tariff by 43%), which is contrary to the law “On Public Procurement”. The price certificates of the Kharkiv Chamber of Commerce and Industry became the basis for making changes to the contract. At the same time, as the court found out, the conclusions of the Kharkiv TPP testify to the weighted average day-ahead market price (DAN) in the United Energy System (UES) of Ukraine, and not to fluctuations (increase or decrease in the price of goods on the market). Therefore, these conclusions (certificates) of the Kharkiv Chamber of Commerce and Industry do not confirm fluctuations in the price of electricity during the period from May, September to October 2021. Advertisement: As a result, the court invalidated a number of additional agreements to the contract on the supply of electricity and charged the LLC ” Ukr Gas Resurs” 684 thousand hryvnias of unreasonably acquired funds. The owner of “Ukr Gas Resurs” LLC is Andriy Kuchkov, the son-in-law of ex-Minister of Ecology Mykola Zlochevskyi.
