The court ordered the father to return 25,800 hryvnias in payments for the child, demanded by social security.

The social security authorities demand the return of the husband’s extra child care allowance for the period from 01.01.2021 to 04.30.2023 in the amount of 25,800 hryvnias. The man received social support when the child was born. However, later it turned out that he submitted two applications for accrual, due to which he needs to reimburse the received money in the amount of 25,800 hryvnias. This is stated in the decision of the Dnipro district court of the city of Zaporizhia, published on January 21, 2026. On January 26, 2021, the man applied to the Department of Social Welfare of the ZMR population in Komunarsky district with a written request “for the appointment of all types of social support, compensation and privileges” for the appointment of social assistance at the birth of a child. On the basis of the request from 01.26.2021, he was granted and paid a one-time payment in the amount of 10,320 hryvnias and state assistance for the payment period from 01.01.2022 to 01.31.2024 in the amount of 860 hryvnias per month. In April 2023, the Office received information from the verification conducted by the Ministry of Finance of Ukraine about double charging and, accordingly, the payment of child care allowance to him for the time period from 01.01.2021 to 04.30.2023 on various personal accounts. An additional check established that on January 22, 2021, he submitted a request in electronic form, according to which assistance was assigned and paid on a personal account, and on January 26, 2021, he submitted a written request to the Office, according to which assistance was assigned and paid on a personal account. At the same time, he did not inform the Office about the existence of an electronic application, and due to the short period of time between the applications, which was checked by the Office when assigning assistance, the presence of duplicates was not detected independently. Double payment of benefits to him was stopped from May 2023. According to the calculation for the period from April 1, 2021 to April 30, 2023, the amount of excess funds paid to him, due to receiving double payments, amounted to 25,800 hryvnias (10,320 hryvnias + 27 months * 860 hryvnias 7,740 hryvnias (deducted from further payments). The specified amount is demanded by social security to be recovered from him.

What did the court decide? The court satisfied the claim. From the husband for the benefit of the state, in the person of the Department of Social Welfare of the Zaporizhzhya City Council, the amount of 25,800 hryvnias will be collected from the husband for the period from 01.01.2021 to 04.30.2023.

“According to the calculation for the period from April 1, 2021 to April 30, 2023, the amount of money overpaid to the defendant due to receiving double payments amounted to UAH 25,800 (UAH 10,320 (one-time) + 27 months * UAH 860 (monthly payment) UAH 7,740 (deducted from further payments). July 25 In 2023 and February 6, 2024, the defendant was sent a notice with a proposal to voluntarily return the overpaid funds. As of the date of the appeal to the court, the amount of the debt due to be returned, which is UAH 25,800, was not returned by the defendant,” the court noted.
