On January 21, the Pecherskyi District Court of Kyiv began a hearing to choose a preventive measure for two generals and a colonel, who were detained the day before on the charge of “failing to provide adequate protection of Kharkiv Oblast during the enemy’s offensive in May 2024.” According to the correspondent of Radio Svoboda, the court first considered the case of Colonel Ilya Lapin. At the beginning of the session, at the request of the prosecution, the judge made a decision to consider the issue in the format of a closed session. The prosecution claimed that the case files contain state secrets. Lapin and his lawyer objected to the closed session, but the court supported the prosecutor’s request. In the end, the court chose a preventive measure for Lapin in the form of detention and began consideration of the case of General Yury Galushkin. On January 20, the press services of the departments reported that employees of the Security Service of Ukraine and the State Security Service of Ukraine detained three officials who “did not provide adequate protection of Kharkiv Oblast during the enemy’s offensive in May 2024.” According to the case file, “the defendants are a brigadier general who held the post of commander of the Kharkiv operational tactical group (OTU), a lieutenant general who was the commander of the 125th separate brigade of the Armed Forces of the Armed Forces of Ukraine and a colonel who previously headed the 415th battalion of this connection”. According to the mass media, it is about Brigadier General Yury Galushkin, Lieutenant General Artur Horbenko and Colonel Ilya Lapin. Investigators state that “the officials did not prepare the defense of the border regions of Kharkiv Oblast and lost control of the battle during the repeated attack of the Rashists on the regional center.” The generals and the colonel did not comment on this report. At another session of the Pechersk Court, the issue of preventive measures against the ex-commander of the 155th Brigade, Dmytro Ryumshin, is being considered. The prosecutor’s office also demanded that the hearing be held in closed session. The court granted this request, the correspondent of Radio Svoboda reports. During the hearing, the prosecution will ask to keep Ryumshin in custody. The lawyers, referring to the resonance of the case, wanted the process to be open. The defense side announced the recusal of the judge. The lawyers of Excombrigadier Dmytro Ryumshin said that they plan to involve monitoring missions from Poland and France in the court hearings, because these countries participated in the training of the 155th brigade. Law enforcement officials suspect the ex-commander of the brigade of the inaction of the military authorities under martial law, saying that he “did not react to the violations in his unit, including the arbitrary abandonment of the military unit by his soldiers.” According to the investigation, separate cases of SZCH took place on the territory of the EU, where the brigade was trained.
