The Northern Commercial Court of Appeal upheld the decision of the Commercial Court of Kyiv, which annulled the decision of the Antimonopoly Committee of Ukraine on the alleged conspiracy between the participants of the auction for the sale of a special permit for the extraction of peat from the “Pyd Borom” deposit in the Ivano-Frankivsk region. The Northern Commercial Court of Appeal upheld the decision of the Commercial Court of Kyiv, which annulled the decision of the Antimonopoly Committee of Ukraine on the alleged conspiracy between the participants of the auction for the sale of a special permit for the extraction of peat from the “Pyd Borom” deposit in the Ivano-Frankivsk region.

We are talking about the State Geological Survey auction held in September 2023 with a starting price of UAH 1.4 million. Eight companies participated in the bidding. The winner — “Metkon Plus” LLC with a bid of UAH 60 million — was disqualified, and the right of redemption passed to “Rozhnyativ Torf” LLC for UAH 35.2 million. The enterprise received a special permit in November 2023.

After the auction, three participants complained to the AMCU, stating possible anti-competitive concerted actions between “Metkon Plus” and “Rozhnyat Torf”. In November 2024, the Committee fined the companies, stating that there was a combination of signs of collusion — from the connections between the founders to the common origin of funds for guarantee contributions.

“Rozhnyat Torf” challenged this decision in court, emphasizing that AMCU has no evidence of concerted actions, and the mere fact of financial or economic relations does not prove a conspiracy.

On May 22, 2025, the Commercial Court of Kyiv sided with the company, and now this decision has been confirmed by an appeal — the PAGS resolution has already entered into force.

Formerly the Antimonopoly Committee of Ukraine fined LLC “Classic-Form” for almost one million hryvnias for violations in 9 cases of purchase of gas stations – they were obtained without proper permission of the regulator.

Antimonopoly Committee of Ukraine (AMCU) on October 2 started consideration cases concerning 155 entities that are part of the five largest pharmacy groups, the press service of the regulator reports.
