The court argued for the application of bail to Shufrych

The Kyiv Court of Appeals made public the reasons for applying an alternative preventive measure in the form of bail in the amount of 33 million 280 thousand to People’s Deputy Nestor Shufrych, who is suspected of treason – this concerns the amicable settlement of the case at the ECtHR.

Details: It is noted that the panel of judges did not agree with the conclusions of the court of first instance that only detention without alternative can ensure the proper procedural behavior of the accused, prevent the risks of evading the court and influencing witnesses.

Shufrych has been held in the SBU detention center for more than two years, and the trial has not actually started.

Currently, the prosecutor does not cite new risks and does not report an increase in the degree of existing risks. And in such a case, detention without an alternative cannot be considered justified and consistent with the practice of the ECtHR.

On December 4, 2025, the ECtHR accepted Shufrich’s complaint regarding the excessive length of detention. The court informed about the possibility to submit comments to the complaint until April 2, 2026 and drew attention to the possibility of consideration of the case under the amicable settlement procedure.

The Kyiv Court of Appeal believes that the amicable settlement of Shufrych’s complaint can be facilitated by the application of an alternative preventive measure in the form of bail. Such a settlement can prevent negative consequences for Ukraine from the ECHR’s satisfaction of Shufrych’s complaint – compensation payments and undermining the authority of the state at the international level.

According to the UP, as of January 17, Shufrych did not pay the deposit.

Prehistory:

• On September 15, 2023, it became known that the Security Service of Ukraine came to search MP Nestor Shufrych, elected from the now-banned pro-Russian party OPZZH. St. George ribbons, medals and uniforms of the armed forces of the Russian Federation were found in his possession. Shufrych was suspected of treason. The SBU also found a document with a scheme of autonomy for the Donetsk and Luhansk regions, dated 2014, signed by Viktor Medvedchuk, the now-deprived Ukrainian citizen, and Shufrych himself.
• At the same time, the court chose a preventive measure for Shufrych – detention without bail.
• On February 8, 2024, Nestor Shufrych was charged with financing the Russian Guard.
• On September 3, prosecutors sent an indictment to the court against Shufrych and his ex-assistant.
