Bill No. 11531 restores the right of servicemen to be discharged from military service due to the death or disappearance of their half-brother or sister while participating in hostilities.

The explanatory note states that the Verkhovna Rada has provided for a postponement of the draft not only for persons whose close relatives, in particular a native “full-blood” but also a “non-blood” brother or sister, were killed or went missing while participating in hostilities in August.

At the same time, according to the law on mobilization, adopted in April, the death or disappearance without a trace of an unrelated brother and (or) sister ceased to be a reason for postponement of the draft.

The Main Scientific Expert Department of the Verkhovna Rada explained that with such an approach conscripts are placed in unequal conditions compared to those conscripts whose corresponding loss occurred with a full-blooded brother and (or) sister.

Based on the contents of the Family Code of Ukraine, both full-blooded and non-blooded brothers and sisters are biological brothers and sisters, because the fact that brothers and sisters have only one common blood relative (father or mother) does not affect the degree of their kinship.

“The draft law is aimed at ensuring equal rights and opportunities for military personnel on an equal footing with men, who have the right to deferment from conscription for military service during mobilization in terms of the right to be released from military service due to the death or disappearance while participating in hostilities of their non-relatives brother or sister,” the document says.

Previously, Ukraine changed the procedure for receiving one-time cash assistance for relatives of fallen servicemen. Funds can be received within three years from the date of the court’s decision to recognize the serviceman as deceased.

Prior to that, the Cabinet of Ministers changed the procedure for paying monetary compensation for unused vacation days to family members of military personnel and police officers. Relatives can receive funds in the event of their death (death).

Also, the Cabinet of Ministers approved a new Procedure for the appointment and payment of one-time cash assistance in case of death (death) or disability of certain categories of persons in accordance with the law “On the status of war veterans, guarantees of their social protection”.

The Cabinet of Ministers allowed payments to the families of the fallen soldiers from the reserve fund – this was reported by the representative of the government in the Verkhovna Rada, Taras Melnychuk, on May 7.
