As People’s Deputy Yaroslav Zheleznyak reported, 228 people’s elected representatives voted for the draft law “On Amendments to Some Laws of Ukraine Regarding Ensuring the Rights of Persons with Disabilities to Work”.
As stated in the document, the state is obliged to create conditions for the realization of all human rights and fundamental freedoms by a person with a disability without any discrimination on the basis of disability and to ensure his social protection.
However, the employment rate of persons with disabilities is extremely low: only about 17% of persons with disabilities were employed in 2021.
The draft law proposes the introduction of the payment of a target contribution instead of administrative and economic sanctions for non-fulfillment of the employment standard.
The project establishes the same legal obligation to employ persons with disabilities for employers in the private and public sectors.
The scope of employment of a person with a disability is determined in the individual rehabilitation program of a person with a disability according to the permission principle. The realization of the right to work by a person with a disability occurs in all spheres and forms, except for those that are directly contraindicated for a person taking into account his functional capabilities.

A person with a disability has the right not to report the fact of disability and the content of the individual rehabilitation program of a person with a disability. The employer is released from the obligation to carry out an individual rehabilitation program if the person has not informed them of the fact of his disability and/or the content of the individual rehabilitation program of a person with a disability
Persons with disabilities who believe they have been discriminated against have the right to file a complaint with state authorities, the authorities of the Autonomous Republic of Crimea, local self-government bodies and their officials, the Human Rights Commissioner of the Verkhovna Rada of Ukraine, and/or the court.
