People’s Deputies registered in Parliament Bill No. 12442, which provides for criminal liability for violation of the legislation on defense, mobilization training and mobilization committed by the heads of territorial centers .
The bill aims to ensure the proper implementation of mobilization legislation and protection of citizens’ rights during mobilization measures. It proposes to supplement the Criminal Code of Ukraine with new articles:
337 (1) – “Violation of the procedure for conducting a medical examination”. Punishment:
- For a deliberate violation that led to a false conscription or dismissal: imprisonment for a term of 2 to 5 years;
- For repeated violation, conspiracy or violation in a special period: imprisonment for a term of 3 to 6 years with a ban on holding certain positions or engaged in certain activities from 1 to 3 years;
- For violations in martial law: imprisonment from 3 to 8 years with a ban on holding certain positions or engaged in certain activities.
426 (2) – “Violation of the order of conscription or acceptance of citizens for military service”. Punishment:
- service restriction for a term up to 2 years, detention in a disciplinary battalion or imprisonment for up to 5 years;
- for violations in a special period: imprisonment from 3 to 6 years with a ban on holding certain positions or activity for a term of 2 to 3 years;
- In the period of martial law: imprisonment from 3 to 8 years with a ban on holding certain positions or activity for a term of 1 to 3 years.
The bill is aimed at increasing responsibility for violation of mobilization legislation, in particular during medical examinations and the process of conscription, in order to guarantee the legality and protection of interests of citizens in difficult wartime.
