SAP sent to court the case of the former deputy head of the DFS, Bilan, for writing off taxes worth more than half a billion

The Specialized Anti-Corruption Prosecutor’s Office has sent an indictment to the court against the former first deputy head of the State Fiscal Service of Ukraine on charges of abuse of office, which resulted in non-payment of taxes to the budget in the amount of more than UAH 641 million. This is reported by the SAP press service, reports UNN.

DetailsIt is reported that during the pre-trial investigation it was established that in June 2017, the first deputy head of the State Fiscal Service of Ukraine, acting in the interests of a business entity, intentionally did not sign the draft decision within the prescribed period based on the results of consideration of the taxpayer’s complaint against the tax notices-decisions of the territorial bodies of the State Fiscal Service of Ukraine.

Due to the inaction of the official, this complaint, in accordance with the norms of the Tax Code of Ukraine, was automatically satisfied in favor of the mentioned taxpayer. The SAP notes that at the same time, in order to cover up his activities, the official deliberately created the appearance of the impossibility of signing such a decision.

It should be noted that the official was the only authorized person in the State Fiscal Service of Ukraine to sign the decision based on the results of consideration of taxpayers’ complaints. Due to the abuse of office by the mentioned employee, the state represented by the State Fiscal Service of Ukraine lost the right to demand the payment of taxes and penalties to the State Budget of Ukraine in the amount of more than UAH 641 million.

The sanction of the article (Part 2 of Article 364 of the Criminal Code of Ukraine) provides for punishment in the form of imprisonment for a term of three to six years with deprivation of the right to hold certain positions or engage in certain activities for a term of up to three years, with a fine of five hundred to one thousand non-taxable minimum incomes of citizens.
