SAP asks VAKS to collect more than UAH 3.3 million of Judge Nikushin’s assets

Verbatim SAP: “On November 28, 2025, the prosecutor of the Specialized Anti-Corruption Prosecutor’s Office, based on the materials of the National Agency for the Prevention of Corruption and the National Anti-Corruption Bureau of Ukraine, filed a lawsuit with the High Anti-Corruption Court to declare as unfounded the assets acquired by the judge of the Kyiv-Svyatoshinskyi District Court of the Kyiv Region in the period 2022-2023.”

The total value of the assets, which the SAP prosecutor is asking to be recognized as unfounded, amounts to more than UAH 3.3 million.

The department does not name the judge. According to “Ukrainian Pravda”, it is about the judge of the Kyiv-Sviatoshyn district court of the Kyiv region, Vitaly Nikushyna.

The NAKC notes that the reason for turning to the SAP was the monitoring of the judge’s lifestyle. Agency employees established that during 2022-2023 the declarant purchased three vehicles at prices that differ significantly from market prices.

In particular, we are talking about a 2013 Mercedes-Benz G 350 TD, which the judge purchased in September 2022 for UAH 10,000, while, according to an expert assessment, the value of the car on the date of purchase was over UAH 2.1 million. Another car – a 2013 Mercedes-Benz G 500 – was bought at the end of 2023 for UAH 529,000 instead of the nearly UAH 685,000 listed in an ad on one of the car sales sites. In addition, at the end of 2023, the judge purchased a 2017 Renault Zoe for UAH 5,000, while experts valued this vehicle at almost UAH 431,500.

After analyzing the incomes and expenses of the judge, his family members and relatives, the NAZK came to the conclusion that they had no opportunity to legally acquire this property. After that, the agency turned to SAP with the initiative to file a lawsuit against VAKS.

SAP filed a lawsuit with the High Anti-Corruption Court to declare these assets unfounded and collect them from the state’s income. The interests of the state are represented in court by prosecutors of the Specialized Anti-Corruption Prosecutor’s Office.

NASK reminds that in accordance with the Law of Ukraine “On Prevention of Corruption”, a person authorized to perform the functions of the state or local self-government, in respect of whom a court decision on the recognition of unjustified assets and their collection into state income has entered into force, is subject to dismissal from office in accordance with the established procedure.

What preceded:

  • In February 2024, “Slidstvo.Info” reported that the judge of the Kyiv-Sviatoshyn District Court Vitaly Nikushyn declared the purchase of a 2013 Mercedes-Benz G 350 for UAH 10,000 in 2022, and a 2017 Renault Zoe for UAH 5,000 at the end of 2023. In a comment to journalists, he explained the low prices as sellers’ reluctance to pay taxes and admitted that the real value of the “Gelendwagen” was about 30,000 dollars. Subsequently, Nikushyn sold this car and bought a 2013 Mercedes-Benz G 500, which he declared for UAH 529,200, claiming that the car was burnt out.
  • In addition, the journalists found out that the judge owns several other vehicles, a house in the village of Gorenichi near Kyiv, non-residential premises in Kyiv and Irpen, and a plot of land in the Kyiv region. In 2023, he received more than UAH 1 million in judicial salary and almost UAH 100,000 in pension.
  • Previously, the Supreme Council of Justice had already submitted a motion to dismiss him for violating the oath and dismissed Nikushin in 2019, but on December 26, 2023, he was reinstated.
  • The judge’s father, Viktor Nikushyn, previously worked as a judge of the Vinnytsia Oblast Court of Appeals and has been retired with lifetime benefits since 2017.
