Ombudsman: there were no decisions that the family of Daletsky, released from captivity, should return the payments

Dmytro Lubinets, the Verkhovna Rada Commissioner for Human Rights, said that so far there have been no decisions that the family of Nazar Daletskyi, released from captivity and presumed dead, should return the payments.

He noted that this is the first case when a person was officially recognized as dead and then returned from captivity.

“I will insist that the rights of our hero, who has been in a Russian prison for a long time, are not violated, as well as the rights of his family. Therefore, now as an institution we are waiting for all the legal answers from the state authorities,” he said on the air of the telethon.

Lubinets believes that the family received the funds legally – at the time of payment, Daletskyi was considered dead. The Ombudsman noted that the state currently does not have a clear action mechanism for such situations, as this is the first such case.

The ombudsman also reported that he sent requests to the Ministry of Defense and the Ministry of Health to analyze the issue of DNA expertise in order to minimize the risk of similar errors in the future.

Earlier, the representative of the ombudsman in the Lviv region, Taras Podvirny, stated that “theoretically” Daletskyi’s family should return to the state a monetary payment of UAH 15 million for the death of a serviceman, the media reported.

“The family must return the funds paid by the state – a one-time financial aid, that’s what it’s called officially, for the death of our soldier. Therefore, this is definitely a legal precedent that will be decided. Now the culprits will be found out, who made a mistake and how, because we understand that DNA is extremely accurate,” he said during a session of the Lviv Regional Council.

The family of Nazar Daletsky was informed that he died in Kharkiv Oblast in September 2022. In early February 2025, Daletskyi returned to Ukraine as part of a prisoner exchange with Russia.
