As he writes Ministry of JusticeinRelevant to paragraph 1 of part one of Article 23 of the Law of Ukraine “On Mobilization Training and Mobilization”, conscripts, which are booked for the period of mobilization and in wartime, are not subject to conscription. Such persons are on a special military account. Nevertheless, the rules indicate only the procedure for crossing the state border of a booked employee on a business trip. There is no clear regulation on the possibility of crossing the border during leave.
It is possible to find out about the order of crossing the border for this category of persons exclusively from explanations of the State Border Service of Ukraine. Since the rules are often changed and do not currently provide for a clear procedure for traveling abroad on leave for booked workers, the final decision is made individually – at the discretion of the Border Service employee during the control.
The Ministry of Justice recommends that on the eve of the trip to clarify the procedure for crossing the State Border Service employees
At the same time, some civil servants, such as members of the Cabinet of Ministers, deputy ministers, judges, prosecutors, heads of state bodies, deputies of local councils, as well as other persons identified in Art. 2-14 rules cannot cross the state border for vacation.
The Ministry of Justice emphasizes that an employee who plans to go on vacation abroad should not have prohibitions that would prevent traveling outside the country or violate military accounting rules.
