On January 7, the Commercial Court of Kyiv issued a decision to levy a fine on Kompaniya Food Pak LLC for violating the terms of delivery of tea and coffee, which were ordered by Kirovohrad OVA for humanitarian aid to the Zaporizhia region.
The order, made by the Kirovohrad regional state administration on April 7, 2022, concerned the supply of tea and coffee in the amount of UAH 9.45 million. In particular, it was about:
- GBOP Indian tea (20 thousand packages of 0.2 kg);
- Kenyan granulated tea (30 thousand packages of 0.2 kg);
- Vietnamese small leaf tea (35 thousand packages of 0.2 kg each);
- Chinese tea GUN POWDER (10 thousand packages of 0.2 kg);
- ground coffee (50 thousand packages of 0.2 kg).
The delivery of the goods was supposed to take place by April 15, 2022, but in fact the cargo arrived only from April 27 to May 3, 2022.
According to the terms of the contract, for delayed delivery or partial delivery of the goods, the supplier is obliged to pay a penalty, which is double the accounting rate of the National Bank of Ukraine for each day of delay of the undelivered goods.
As a result, the court ordered Food Pak LLC to pay 73.12 thousand. UAH for late delivery of goods.
