According to the prosecutor’s office, the Commercial Court of Kharkiv region satisfied the claim of the head of the Bohodukhiv District Prosecutor’s Office against a private enterprise, which used a reservoir of more than 160 hectares for fishery needs without the necessary legal documents and a lease agreement.
The enterprise operated according to the fishery operating regime, but without a contract, which has not received a rent for years. The court obliged a private enterprise to release the reservoir and transfer it to the community. The appellate appeal is still ongoing.
The prosecutor’s office notes that the case demonstrates a widespread practice when businesses try to use water bodies for aquaculture without an official lease agreement, avoiding payment of funds to the community. The Supreme Court has repeatedly emphasized that the legitimate use of the reservoir for fishery needs is possible only in the presence of a concluded lease, and the use without it violates water and land legislation.
North Appeal Economic court satisfied The appeal of the Kyiv City Prosecutor’s Office and obliged the private company to return the land plot of the water fund on the street in Pryryna in Obolon district. It is a plot of almost 5 hectares, worth more than UAH 632 million.
