In the coming months, the International Coordination Group for Victims of Flight PS752 will take the next steps to hold Iran accountable at the International Civil Aviation Organization (ICAO) Council.
This is stated in the statement of the Ministry of Foreign Affairs of Ukraine.
It is noted that 5 years ago on this day, the Islamic Republic of Iran killed 176 people on board flight PS752 of Ukraine International Airlines in Iranian airspace. Iran grossly violated a number of norms of international law: it used weapons against a civilian plane in flight, did not take all measures to prevent the downing, did not provide either a transparent and objective investigation into the circumstances of the disaster, or proper prosecution of the accused.
The Ministry of Foreign Affairs of Ukraine expressed its condolences to all the relatives and friends of those killed on board flight PS752 and assured that they will spare no effort to achieve justice and bring those responsible for the tragedy to justice.
The department recalled that a year ago, the International Group for the Coordination of Victim Assistance, consisting of Ukraine, Canada, Sweden and the United Kingdom, initiated proceedings within the framework of the ICAO Council against Iran due to its violation of the Convention on International Civil Aviation of 1944 (Chicago Convention).
“This proceeding is ongoing, and the next steps of the Coordinating Group to hold Iran accountable in the ICAO Council will be taken in the coming months,” the agency emphasized.
In October 2024, the Coordination Group also submitted a Memorandum as part of the review of the PS752 downing case at the UN International Court of Justice. Ukraine, Canada, Sweden, and the United Kingdom then supported this document in the case with indisputable evidence of Iran’s violation of the 1971 Convention for the Suppression of Unlawful Acts Against the Safety of Civil Aviation (the Montreal Convention).
In addition, the ministry emphasized that today Iran continues to confirm its status as a murderer, providing Russia with military and political support in its armed aggression against Ukraine, and the deepening cooperation of the regimes in Moscow and Tehran poses a direct threat to Europe and the Middle East.
“Impunity for past crimes prompts Iran and Russia to new and new violations of international law. That is why the achievement of justice is so important,” the Ministry of Foreign Affairs of Ukraine noted.
Kyiv has already called on the international community to join forces for the sake of international peace and security, including the safety of international civil aviation, and the prevention of such disasters in the future.
We will remind you that on the night of January 8, 2020, a Boeing 737-800 NG plane of the “Ukraine International Airlines” airline company headed to Kyiv crashed after taking off from Tehran airport. 176 passengers from seven countries were on board the liner, all of them died.
On January 11, the General Staff of the Armed Forces of Iran admitted that the Ukrainian plane was shot down by a surface-to-air missile. Iran also admitted that the plane was shot down by Russian-made Tor-M1 air defense missiles.
During the investigation into the incident, Iran refused to cooperate with Ukraine on some aspects of the disaster and withheld the names of the suspects.
In March 2021, the Iranian Civil Aviation Authority released the final report on the downing of the airliner. The official cause of the crash was an error by the air defense operator, who identified the plane as an “enemy target.” Ten Iranian officials were accused of destroying the liner.
The airline “International Airlines of Ukraine” (UAI) has filed a lawsuit against Iran for the downed passenger plane. The lawsuit includes demands for compensation from Iran and the Islamic Revolutionary Guard Corps.
On April 16, 2023, Iran announced the sentences of 10 servicemen involved in the downing of a Ukrainian plane. One commander was sentenced to 10 years in prison, the rest received terms from one to three years.
