LIGA.net writes about this with reference to the clarification from the Ministry of Justice of Ukraine.
The department noted that alimony is usually withheld from the income received by the debtor. Usually it is a salary, but a part of his pension, stipend and other income can also be withheld.
In order for alimony to be withheld from income automatically, the executive body must apply to the enterprise, institution or organization that pays the debtor a salary (or other regular income).
However, many citizens who are required to pay alimony often evade such payments by transferring their income to unofficial channels that are difficult for government authorities to track.
As explained in the Ministry of Justice, if a citizen does not pay proper alimony within three months, additional coercive measures may be applied to him. In particular, he can be entered into the Unified register of debtors, after which his debt for alimony can be repaid already at the expense of his property.
In addition, in some cases, a criminal case may be opened under the article on alimony evasion. According to Art. 164 of the Criminal Code, those guilty of such a crime face compulsory community service, law enforcement supervision, and even restrictions on their freedom.
Alimony from the state: what you need to knowAs UNIAN wrote, if one of the parents, who is entrusted with the obligation to pay alimony, evades these actions, the state can pay child support instead.
The amount of such assistance is calculated as the difference between the subsistence minimum for a child (which depends on age) and the average family income per person for the last 6 months. The maximum amount is UAH 2,563 for children under 6 years of age and UAH 3,196 for children aged 6 to 18; minimum guaranteed amounts – UAH 1,281.50 and UAH 1,598, respectively.
