Kerner and Freund refer to a coalition agreement between the Christian Democratic Union (CDU) and the Social Democratic Party (SDP), which contains a “much more consistent use of existing protective instruments”, including deprivation of the right of voice in the EU Council.
The European Parliament has initiated the proceedings against Hungary under Article 7 in 2018, but since then a slight progress has been made. The Council of Ministers will take place on this issue on May 27. The EU Council will have to vote unanimously – except for Hungary itself – to declare that there is a “serious and constant violation of the rule of law, democracy and fundamental rights” in Hungary. ”
The Ministry of Foreign Affairs must work with “like-minded member states in order to establish serious and constant violations” by Hungary, according to a letter from deputies. In another letter, a group of deputies has already called on the European Commission to withdraw all EU funding from Hungary.
Article 7 of the Treaty on the European Union allows to suspend certain rights of the Member State, in particular, the rights of vote, if there is a serious and constant violation of the Member State of Fundamental Values of the EU.
After Brussels closed a similar case against Poland in May 2024, Hungary is currently the only EU state to launch a sanction procedure, in accordance with Article 7 of the EU Treaty.
In April 2025, the Estonian Foreign Minister Margus TSAKHKN said that in the European Union they were approaching the deprivation of Hungary’s voting rights in the EU Council through blocking its decisions on Russia.
