Ukraine has launched anti -dumping investigations into the facts of evasion of payment of duties on imports into the country of some types of metal products by origin from China, which was allegedly from Malaysia.

This is stated in the reports of the Interagency Commission on International Trade.

The law firm Ilyashev and partners initiated the first anti -dumping investigation in the history of Ukraine on the evasion of anti -dumping duties, the lawyer said.

It is noted that the complaints of national producers, whose interests are represented by this law firm, give convincing evidence that the effect of the use of anti -dumping duties on import from China could be offset by the supply of similar products from Malaysia and artificial lowering of customs value, which is used as a basis for accrual.

At the same time, as a result of the violation of the investigation, the action of anti -dumping duties on carbon steel in origin from China in the amount of 30.76% to 48.14% was extended to imports of similar products from Malaysia.

It is the first in the history of Ukraine to apply the provisions of Article 27 of the Law “On Protection of the National Producer from Dumping Imports”, which provides for the possibility of violation of a special anti -dumping investigation into the fact of evasion of anti -dumping duties. It has become a precedent for response to the state to change the structure of trade and the use of bypass schemes that had previously remained outside the legal regulation, ”the lawyer notes. – “For the first time an anti -dumping duty will be charged from the moment of violation of the investigation into a deposit account opened by the State Treasury Service in the name of the State Customs Service. The ICMT for the first time identified the mechanism for depositing appropriate funds to ensure payment of duties and VAT share. ”

The ICMT also concluded that the import of wires from Malaysia is used to bypass the final anti-dumping duty for Chinese products installed in 2023 at 32.6% for Silicon-Marganseva steel wires, the lawyrm reported.

After the duty on Chinese wires, the proportion of their imports decreased. Instead, the presence of similar products from Malaysia has increased on the market, which offsets the effect of the measures applied and causes damage to the Ukrainian manufacturer, ”the message reads. – “To prevent further bypass anti -dumping duties, ICMT has made a decision to recover advance payments (Including VAT) from Malaysian exporters at the current rate for China – 32.6%. Such a mechanism will act until the investigation is completed. “

Law firm Ilyashev and partners ”also initiated an investigation into the facts of dealing with anti -dumping duties on the import of steel mounts from China through the supply of similar products from Malaysia. Duties for Chinese mounts were set in 2020, its size is from 32.47% to 67.4%.

After the introduction of final anti -dumping measures against China, the proportion of its imports decreased sharply. At the same time, the import of similar products from Malaysia increased, which actually neutralized the duty and posed a new threat to the national manufacturer, ”the message reads. – “In order to prevent further bypass duty, the commission obliged the Malaysian exporters to make advance payments (including VAT) at 67.4% – rates set for Chinese manufacturers. This mechanism is valid until the investigation is completed. “

As reported, Ukraine is introducing final anti -dumping duties for manufacturers and exporters of radiators for heating from Turkey and China for five years. Their size depends on the specific exporter.

For manufacturers and exporters of radiators from Turkey, an import duty is introduced in 37.35%, with a PRC – from 23.3% to 42% depending on the exporter.
