Before the meeting, Horinov stood in a cage with a poster “Stop killing. Let’s stop the war.” The bailiffs tried to take away this poster, to which the deputy replied that they should draw up an act of seizure.
Horinov, sentenced to seven years in prison under the article about “fakes” about the army, is now accused of justifying terrorism (part 1 of article 205.2 of the Criminal Code) due to conversations with fellow inmates about the Ukrainian Azov battalion and the blowing up of the Crimean bridge.
Dmytro Muratov, the former editor-in-chief of Novaya Gazeta and Nobel Peace Prize laureate, said that prisoners with hidden microphones were specially placed in Horinov’s cell to record all conversations with him. In addition, the administration put a TV in the cell so that the prisoners could watch the news. The jailed cellmates took Horinov out to discuss news, primarily events in Ukraine.
As “Mediazona” notes, during such a conversation, the cellmate told Horinov that only “Banderov” were fighting on the side of Ukraine, to which the deputy replied that the armed forces were fighting there. This is one of the phrases that formed the basis of the accusation in the new case.
Lawyer Olena Savelieva asked the court to return the criminal case to the prosecutor due to violations at the investigation stage. According to her, the indictment does not contain a detailed and clear statement of the accusation.
In addition, the motive of the crime cannot be understood from the indictment, the lawyer said. She explained what is said there, but there is no confirmation that Horinov is a supporter of “nationalist ideology”, “supports the coup d’état” in Ukraine in 2014 and the subsequent “nationalist policy of this state”, does not support the “accession” of Crimea to Russia.
The prosecutor also announced the indictment at the first meeting. It states that from December 15 to February 9, 2023, Horinov was treated in the colony with a diagnosis of “out-of-hospital left-sided pneumonia.” From January 1 to January 20, 2023, he was held there with four prosecution witnesses in one chamber. According to the investigation, they developed a trusting relationship, as a result of which Horinov allowed himself statements that justified destructive actions – the explosion on the Crimean Bridge and the actions of the “Azov” battalion.
