On August 15, Elena Shcherban (or Shcherban – Choose for yourself, because even the media did not agree) declared “pressure” and an attempt to deprive it of a lawyer’s license.
According to the lawyer, two complaints from the Volyn Qualification and Disciplinary Commission of the Bar are connected with the law of their professional level. And she sees this insidious connection with her work on the affairs of Vitaliy Shabunin and NABU detective Ruslan Magamedrasulov.
The media, friendly to the Center for Combating Corruption (CPC) and Shabunin, immediately rushed to inflate this “scandal”, ignoring the obvious holes in logic.
We will try to understand these holes.
Let’s start with the letter, the absence or presence of which is completely different to look at this, in fact, a simple story.
Here, look: in the Unified Register of Bar of Ukraine (Erau), Elena Shcherban is registered – without a soft sign. There is no “Shcherban” there. For a lawyer, this is not a stylistic trifle – it is a question of identification! But the media, even those who wear Shabunin on their hands, stubbornly write “Shcherban”. Why? Perhaps convenient camouflage? Because if you go to Elena Shcherban, then its position quickly appears: Deputy Executive Director and Head of the CPC’s legal department, where Shabunin is the chairman of the board.
Subordinate, associate, and of course, the recipient of salary signatures from the chief. But in statements and news about it – a word! Maybe not to spoil the image of an “independent lawyer fighting the system”? Or maybe that it is more difficult to “governs” her connections?
Elena Shcherban then complains of a “wave of discredit” in Telegram channels, where it is identified with Shabunin. “She has been a victim of bullying because of a client’s protection,” she is indignant. And here the question arises: is not it logical to identify the CPC employee with her boss, with which she divides office, values and struggle?
But no, she said, it is unacceptable! And here on the stage comes the bill No. 12320, which forbids the lawyer with the client and awaits the signature of the President. And this would seem to please Shcherban. But no! The CPC, where it works, with Shabunin, inhibits this law, calling it “the threat of freedom of speech.”
That is, when they identify others, is it good, and when it is already pressure and bullying? Strange logic, isn’t it? Maybe it would be worth viewing the position of the CPC to protect yourself from the same Telegram-Ataches that are so annoyed?
Now about the so -called “terrible pressure”. Shcherban honestly confessed: she did not increase her professional level, because she did not want to pay “big money” in the accredited NAAU schools, associated with how she convinces everyone, with Lidia Izovitova – Head of the National Advocates of Ukraine and Council of Advocates of Ukraine.
“Last year, many lawyers did not pass in principle,” says Ms. Shcherban. Well, bravo for principle! But there is one “but”: the procedure for raising the professional level of lawyers of Ukraine is not a whim of Izovitova, or someone there, but a requirement of the Law on Advocacy and Advocacy. Training is a must for everyone, with points and all attributes. However, Shcherban believes that complaints from the CDCA are formal. So why does she associate them with “Shabunin and Magamedrasulov’s affairs”?
It is worth recalling Magamadrasolov in a pre -trial detention center, Shabunin in the center of scandals – but is it the right to ignore the rules? Maybe it would be worth giving an explanation rather than looking for a conspiracy?
Therefore, we summarize that the behavior of the CPC and its “registered anti -corruption” has long ceased to amaze. But it is unfortunate that through such stories, the world perceives Ukraine as a country where the rules are something optional, and HIP is the main tool of struggle. Elena Shcherban could simply fulfill the requirements of the law, submit explanations and work on. But no – it is better to arrange a show about “persecution”. Introducing in any way observers are misleading their accusations, manipulations, double standards and even their own name.
