In Ukraine, a special Defense City regime has officially started, which should simplify working conditions for enterprises in the defense sector. On January 15, the Ukrainian Council of Gunsmiths held a closed offline meeting “Among gunsmiths: Defense City has worked, how to become a resident?”, dedicated to the practical aspects of the new mechanism. One of the key advantages of Defense City was the possibility of exporting defense products without obtaining separate special authorizations from the Cabinet of Ministers of Ukraine, which previously could take six to twelve months. The relevant export procedure is provided for in a separate order approved by the government at the beginning of this year.

The head of the State Export Control Oleg Tsilvik emphasized: Defense City residency does not mean the cancellation or simplification of export control procedures.
Registration with the State Export Control Service of Ukraine and obtaining a permit remain mandatory.
Today, about 30% of the surveyed arms manufacturing companies have registered with the export control service of Ukraine, which is the first step towards entering the international market.

Export procedures
To help manufacturers navigate export procedures, the Ukrainian Council of Gunsmiths created the Export Support Office.
During the first month of operation, the Office provided more than 20 individual consultations for companies in the field of defense industry on entering international markets.

Andriy Tyvonchuk, Director of the Department for Defense Industry, Military-Technical Cooperation and Export Control of the NSDC Apparatus, outlined the role and functions of the Interdepartmental Commission for Military-Technical Cooperation and Export Control.
He informed that the meeting of the commission will be held immediately after the formation of its updated composition.
Residency, registers and legal nuances
Viktoriya Komisarenko, Deputy Director of the Strategic Development Department of the Ministry of Defense, provided detailed explanations regarding the acquisition of Defense City residency:
- Residency provides companies with significant tax benefits (exemption from income tax upon reinvestment), simplified customs and currency procedures and support for relocation to safer territories of Ukraine;
- To start, enterprises must conduct an internal audit for compliance with residency requirements;
- At the next stage, the company submits an application to the Ministry of Defense for granting resident status. The key is the Compliance Report, which shows the annual financial statements. At least 75% of qualified income (50% for aircraft construction) must come from defense activities.

Legal partners from Juscutum — Dmytro Palyushchenko, head of the business support practice, and Petro Bilyk, partner of the technology and investment practice — emphasized the critical role of well-prepared defense contracts.
They emphasized the importance of proper intellectual property protection, clearly defined terms of supply and correct arbitration clauses.
Particular attention was paid to clear mechanisms for working with export-import licenses and verification of counterparties and end users.
Register of gunsmiths and Register of Defense City
Director of the Directorate of Digital Transformation in the Defense Sector of the Ministry of Defense of Ukraine, Artem Romanyukov, presented the vision of the Register of Gunsmiths, which the Ministry of Defense plans to launch in February-March.
The register should become a secure electronic platform for interaction between manufacturers and state customers and simplify some of the bureaucratic procedures.
Currently, it is not synchronized with the Defense City registry, but such integration is considered a logical next step and requires changes in the regulatory framework.
Speakers at the event emphasized that Defense City is a new tool that has just begun to work, so questions and challenges will inevitably arise during the implementation process.
The Ukrainian Council of Gunsmiths systematically collects requests from manufacturers, fixes problematic points and, in cooperation with state bodies, works to improve regulation.
