Outdated approaches were risky and new ones are not well implemented. Almost without exception, the military is forced to look for places for recreation after positions, paying for renting premises in settlements under constant shelling – often at prices exceeding Kiev or Lviv. “Home searching – farce …” The incentive for the discussion was the post of the soldier of the 56th separate infantry Mariupol brigade, a public activist Sergei Gnezdilov. He thought:

– Why do not have the authority to provide military empty premises in the frontal lane under the conditions of martial law? Who should decide this? It’s not about money. In frontline cities, Kramatorsk agglomeration, every second house is empty. The soldiers have to bargain – the cost of renting a private house reaches more than 20,000 hryvnias, and even for such money to find something acceptable – almost impossible!

Under the post – numerous comments that emphasize the relevance of the problem. “20 thousand for a house where no one has lived and there are no basic conditions – it is simply dishonor,” – writes the volunteer of the Armed Forces, Presopice Anastasia Blyshchyk. “The search for a home is an exhibition where the military play the role of clowns. Six months ago, a host of an empty house got through his neighbors. It is in Europe. Asked permission to settle. Refused. Now there are ruins. But apparently, the floor was removed in the cellar … ”, – says the fighter Mykola Manuilenko.

Occasionally, some cases where displaced persons provide their homes to defenders or village councils organize the accommodation of units. However, dissatisfaction prevails. In Druzhkivka, less than 20 km from the front, renting an apartment with normal conditions costs 2000-7000 UAH (checked through advertisements on OLX). But for military prices, they start from 10,000 and continue to increase. This is associated with a number of factors: the fear of the military or the perception of them as wealthy because of high combat payments.

– It seems not too expensive when five men settle for 20,000, and for a dozen – and in general a penny. But the more fighters in one place, the higher the risk of betrayal and rocket strike. This is understood by the homeowners and the military themselves. Large groups are dangerous, ”he explained Briefly about The fighter with the call sign “Kalina”. – Many give up short -term leases, require a contract for half a year. The threat of fighters is the duty of the fighters themselves About the crazy prices for the military – 20,000, 30,000, 40,000 hryvnias for a regular rural house without water and repair – says the commander of the UAV unit Igor Lutsenko. He ironically calls the army a “uncertainty zone.”

– The state and local authorities ignore this painful topic. The military vertical also does not take responsibility. If the commander of the part is initiative, he tries to do something. But in general, army norms do not provide for such obligation. The fighters resolve the issue of residence on their own, – the scout states.

He accuses the Soviet system, which envisaged the mass placement of troops in barracks, hostels or infrastructure.

-According to the regulations, housing issues should solve the apartment and operational department of the brigade. Its manager concludes a contract for placement, which prescribes utilities. But I have not heard about a fixed rent, – notes Military Lawyer Roman Likhachev from the veterans support center.

According to Lutsenko, the mass settlement, which was practiced at the beginning of the war, cost thousands of fighters and billions of hryvnias of compensation to the families of the dead. As an example, the tragedy at the Desna Training Center, where 87 people were killed from the Russian blow. The Soviet concept of “concentration” does not take into account modern high -precision weapons.

Teaching instructors in the rear, they are also advised to rent a home. Therefore, near landfills, aerodromes and military bases, prices increase 1.5-2 times.

Payments to contractors, mobilized – without guarantees The state should finance the rent for fighters! The military is eligible for free accommodation in abandoned homes! Because without their protection there will be neither homes nor cities. This is indicated by everyone who faces the problem. The Defense Ministry declares compensation:

  • In Kiev – 4560 UAH,
  • In regional centers – 3420 UAH,
  • In other settlements – 2280 UAH.

In addition to criticism about the amounts, there is another nuance:

– payments for rent are provided only for contractors. The mobilized do not receive anything, – emphasizes Roman Likhachev.

This creates another problem – “the right to free accommodation” is often realized arbitrarily.

– My son serves in Kharkiv region. They are placed in abandoned homes with a street toilet. But he does not complain – better than in the trench. He does not pay money, – said Ludmila Kiev.

Social networks describe that such settlement often occurs with the silent consent of the local – “not to see the problem – and there is no problem.”

– This is a violation of property rights. There are many complaints from the owners from Kupyansk and other cities: the fighters remain, they are wrapped up for light for 50,000 hryvnias and disappear. Or things disappear. There are different people in the army, ”Likhachev says. – The problem is that there are still no legal grounds for forced settlement.

Lutsenko says this, remembering millions of free real estate meters.

– When the fighters occupy the house, suddenly a local police appear, which “protects” the property. To the absurd: acquaintances fought for a town, the western part of which was still kept, and the east was already stormed by the invaders. They tried to settle in the house – the district (!) With the ban came under fire, – he says.

Duty is, the mechanism is no Paradox: The Law on Legal Martial Status (2015) in paragraph 17 of Part 8 provides for “military-apartment obligation” for individuals and legal entities. It concerns RO displacement of military, law enforcement officers and evacuees.

This provision should be regulated by the Cabinet of Ministers, but they are still gone. But in 2020, the government tried to cancel the apartment duty twice, but because of the resistance of the deputies – withdrew the draft laws.

– The law could solve the problem. But leaders of all levels avoid responsibility, answering “lack of mechanisms”, – Lutsenko said.

Also, since 2013, the Law on Coercive Alienation of Property during the War has been in force. This also applies to private real estate. But the state should fully compensate for the value that is pointless if the house can be destroyed in a month.

Making the laws on war in peacetime is one thing. It is quite different to apply them during the war.
