On February 28, the reservation period for all conscripts in Ukraine ends. Some men can be mobilized, because the current legislation does not provide for a mechanism that would allow waiting until the employee is rebooked.
People’s deputy, member of the Verkhovna Rada committee on national security, defense and intelligence Oleksandr Fedienko reported this.
“On February 28, the reservations of all conscripts in the country expire. The current legislation does not provide for a mechanism, wait now, we will overbook the employee here, we did not have enough time.” – wrote Fedienko.
If the enterprise loses its criticality status (the state contract has ended, there is no new one), or it does not meet the criteria (Decision 76), then the reserved employees of this enterprise will also lose their reservation, or the head of the enterprise did not receive the relevant criteria in time, he explained.
“Considering that such conscripts are all registered, the TCC has the full right to mobilize such conscripts. Everything is within the law. Yes, even now I have met heads of TCCs who understand these issues, and, for example, for workers of defense enterprises, telecommunications enterprises, energy industry, they go to the meeting giving time for rebooking”, Fedienko noted.
According to him, the mobilization task is the reservation of conscripted workers, usually in the agro-industrial sector, for the production of goods, understanding the volume of production of the necessary products for the military.
“The mobilization task should be set taking into account the capacity of enterprises, that is, it should be such that the enterprise can fulfill. That is, for example, the ODA sets a mobilization task taking into account the needs of the Ministry of Defense and the capabilities of the enterprise. During the last inspections of the State Administration of Compliance of such enterprises in terms of capacity, some of them lost the mobilization task. But the workers at that time remained booked,” Fedienko explained.
At the same time, reservation is a type of postponement, Article 23 of the Law.
“The reservation of an employee is established by the Ministry of Economy. And even if the company lost the mobilization task at that time, the reservation of the current employee remained valid. Unfortunately, it is becoming more and more difficult to find a balance between the formation of reserved workers for critically important enterprises, and the mobilization and replenishment of the personnel of the Armed Forces,” said Fedienko.
Therefore, after February 28, a certain percentage of conscripts who were booked can be mobilized to the Armed Forces of Ukraine and other military formations.
“Perhaps it is worth taking care of joining the relevant military unit through the recruiting mechanism, the current legislation allows this,” Fedienko added.
As a reminder, from the end of December 2024, employees of critical enterprises can book again through the Diya portal.
Also, a new service is already available on the “Diya” portal – cancellation of reservations for conscripts.
