The Cabinet proposes to plant for illegal border crossing during the war

The Cabinet of Ministers has submitted to the Verkhovna Rada a bill on the introduction of criminal liability in Ukraine for illegal crossing of the state border during martial law. There is a penalty of 119 thousand to three years in prison.

Literally In the project of Law No. 13673: “… to supplement Article 332 of the Criminal Code of Ukraine (illegal transportation of persons across the state border) with a qualifying feature in the form of criminal offense in the conditions of martial law … to establish criminal responsibility for the illegal crossing of the state border in the conditions of martial law or state of release.

Details: For the corresponding offense, the law proposes to punish a fine of 7 to 10 thousand non -taxable minimum incomes of citizens (from 119,000 to UAH 170,000) or imprisonment for up to three years.

At the same time, the Cabinet proposes to release those who illegally left Ukraine, but for three months returned back and voluntarily surrendered to law enforcement. This should be done before the suspicion report.

The explanatory note to the bill states that “conscripts (conscripts, reservists) for the illegal crossing of the state border of Ukraine can only be brought to the administrative responsibility provided for in Article 2041 of the Code of Administrative Offenses, but this does not have a proper punitive and preventive impact.

The Cabinet of Ministers also states that there are no provisions in the law of law that violate the rights and freedoms guaranteed by the Convention on the Protection of Human Rights and Fundamental Freedoms, or the equality of the rights and opportunities of women and men and create grounds for discrimination. The legislator also assures that the law does not contain the risk of committing corruption offenses.

The Government hopes that the new law “will help to ensure the legal regulation of persons’ liability for crossing the state border of Ukraine for the purpose of evasion of conscription for military service during mobilization.”
