Details: The claim of Hungary, filed in July against the Council of the European Union and the European Peace Fund, was adopted by the EU Court before consideration this week. It concerns the decision of the EU Council of May 2024, which laid the basis for the use of immovable Russian assets to provide further assistance to Ukraine – including the military.

It is known that the EU then decided to transfer almost all revenues from the taxation of income of frozen growths to the European Peace Fund (EFM), from which the cost of military assistance to Ukraine is compensated for member states.
Hungary is known to have blocked the approval of such payments from the European Peace Fund for a long time for a total of more than 6 billion euros – even when it has received assurance that its contribution to the Fund will not be sent to financing weapons for Kiev.
But the fact that the Hungarian side has maintained during the approval of the decision on growths, gave the EU grounds to claim that the funds from the Rosactives transferred for the EFM (estimated, may be about 3-5 billion euros a year) can be used without Hungary’s consent.
Hungary, accordingly, demands invalidation of the decision of the Leadership Committee of the European Peace Fund of March 2025 to implement the decision of the EU Council on the use of profits from growths for financing military assistance to Ukraine.
It precisely stipulates that the voice of Hungary as a state that has abstained when creating such a source of financing should not be taken into account when making decisions on the allocation of individual funds.
According to Budapest, this procedure violates the basic principles of legal decision -making set out in the basic EU treaties, and therefore must be canceled.
At present, the prospects for the Hungarian claim are incomprehensible, as the EU court can last for years, and the procedure for using revenues from growths has already changed compared to, and some of them are referred to Ukraine’s non -military support.
Recall: Hungary is also systematically slowing down Ukraine’s accession to the European Union and blocks the opening of the first negotiating clusters.
