As Jozwiak noted, the European Union Intellectual Property Office (EUIPO) refused to register such a trademark in 2023.
As Politico wrote, a team of lawyers on behalf of the DPSU tried to convince EUIPO to register the message of the Ukrainian border guard for the Russian ship as a trademark.
At the same time, according to European law enforcers in the field of intellectual property, the expression does not meet the requirements to become a trademark.
Lawyers first filed a trademark application on March 16, 2022, on behalf of the soldier who first uttered the phrase, at which time the EUIPO said the slogan would be perceived as “contrary to generally accepted principles of morality.”
To avoid accusations of speculation in the war and for security reasons related to the disclosure of the soldier’s name, the lawyers submitted a second application already on behalf of the DPSU, but the department again rejected the application.
The lawyers filed an appeal in February 2023, but the EUIPO rejected it last December, arguing that the phrase lacked “distinctiveness”.
In February 2024, the lawyers again filed an appeal against the refusal.
In January 2023, it was written that Lithuania recognized the appeal of the Ukrainian defenders of Zmiiny Island as the phrase of 2022.
Also, at the beginning of January 2023, American diplomats in Kyiv spent New Year’s Eve in the shelter of the embassy due to air alarms, and said that during this time they also chose a message for a Russian ship as the phrase of the year.
